EB-1A is a category under the first preference of U.S. employment-based immigration for individuals with extraordinary ability. It is designed to help outstanding talents who have achieved significant accomplishments or made exceptional contributions in their fields obtain U.S. permanent residency (Green Card).

Eligibility Requirements

Applicants must demonstrate extraordinary ability in science, arts, business, education, or sports, and must be among the small percentage of top experts in their field, with recognized national or international acclaim.

Applicants must prove they are among the top 5% globally by meeting either:

  • One internationally recognized major award (e.g., Nobel Prize, Oscar, Grammy, etc.)

OR meet at least 3 of the following 10 criteria:

  • Evidence of lesser nationally or internationally recognized awards for excellence (major awards at national or global level)
  • Membership in associations requiring outstanding achievements (professional associations)
  • Published materials about you in major media or professional publications
  • Evidence of judging the work of others individually or as part of a panel
  • Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance (e.g., patents, innovations)
  • Authorship of scholarly articles in professional journals or major publications
  • Evidence that your work has been displayed in exhibitions or showcases (artistic field)
  • Evidence of holding a leading or critical role in distinguished organizations
  • Evidence of high salary or significantly higher compensation compared to peers in the field
  • Evidence of commercial success in performing arts (e.g., box office sales, music sales, online views, etc.)

Application Process

Step  Application Process 
1 Sign agreement and prepare required application documents (15 days – 3 months) 
2 Submit I-140 petition 
3 I-140 approval (approximately 9–12 months) 
4 Case transferred to the U.S. National Visa Center (NVC), waiting for interview notification 
5 Visa approval
– If applicant is in home country: attend interview in Guangzhou and obtain visa 

– If applicant is in the U.S.: file I-485 Adjustment of Status 

6 Enter the U.S. within 6 months and receive Green Card (issued approximately 1–2 months after entry)
